1. The Contest shall commence from June 22, 2009 at 00:00:00 hours and shall end on August 11, 2009 at 23:59:59 hours ("Period") on the Channel.

2. By this Contest the viewers will be asked to vote for the fresh face, among the three (3) female contestants i.e., Koel, Tanima and Tanaya in the program titled "Swayamwar" ("Program").

3. During the show, there will be a contest slate wherein the viewer(s) will be asked to vote for the fresh face among the three (3) females contestants i.e., Koel, Tanima and Tanaya. The contest slate shall also state the mechanism (manner) in which the viewers can cast their votes.

4. A viewer(s) interested in casting his/her vote for the fresh face should SMS "FRESH" followed by followed by contestant code i.e. 01 for Koel , 02 for Tanima or 03 for Tanaya to 57827.

5. The viewers who are subscribers of Vodafone, Aircel, Idea, Reliance Communications, Spice, BSNL, Tata Indicom, Airtel, Reliance Telecom, BPL, MTNL Mumbai, will be able to participate in the Contest by sending an SMS.

6. The cost charged to the viewers by the mobile operators for each SMS will be as follows:

Rs. 3: Vodafone, Aircel, Idea, Reliance Communications, Spice, Tata Indicom, Airtel and BPL.

Rs. 2: BSNL.

Rs. 1: MTNL Mumbai.

7. The cost of each SMS shall be charged by the respective operators. Neither STAR Entertainment Media Private Limited ("SEMPL") nor the Channel shall be responsible in case of any network problem and/or the costs charged by the mobile operator. Any dispute in connection to the same shall be settled directly between the subscriber and the operator without involving SEMPL and/or the Channel.

8. Neither SEMPL nor the Channel shall be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the network operator. Any dispute in connection to the same shall be settled between the subscriber and the network operator without involving SEMPL or the Channel.

9. In case of telecom and/or network failure and/or for any other reason whatsoever, SEMPL reserves the right to change the mechanism or take such necessary steps as it may deem fit.

10. The viewers must send in their entries any time during the Period. Vote(s) sent after the time lines stated herein shall not be considered and shall be invalid.

11. The contestant who gets the maximum votes will win a gift hamper from Dabur Gulabari in the finale episode of the Program. Channel/SEMPL shall give the Dabur Gulabari gift hamper to the winning contestant.

12. It is expressly stated that this is simply an Contest to enable the viewers to select fresh face in the Program. Therefore, there shall be no winners declared or prizes distributed for this.


GENERAL RULES

1. SEMPL or the Channel reserves all rights to make amendments to the existing rules without prior notice.

2. The viewer(s) interested in participating in the Contest must be above the age of 18 years and a resident of India.

3. The voter(s) of the Contest agree that he/she shall hold harmless the Channel, SEMPL, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the sponsor and/or the Channel and/or SEMPL to claim any damages or relief's or otherwise.

4. The Channel and/or SEMPL is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the voter in any manner whatsoever, in connection to the Contest.

5. Employees of the Channel, SEMPL, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to vote and be part of the Contest.

6. The participation of the viewer(s) in the Contest shall mean that the viewer(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.

7. Non-conformance by a viewer of the rules of the Contest will make such viewer's votes null and void.

8. SEMPL reserves all rights to make amendments to the existing rules and regulations without prior notice. It shall be the sole responsibility of the viewers to check the rules and regulations of the Contest on the website of Channel.

9. The outcome of the Contest/the decision made by the Channel and/or SEMPL regarding the Contest shall be final and binding on the viewers and in no event shall the viewer/voter dispute the decision made by SEMPL, Channels and/or its employees in connection to the Contest.

10. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by SEMPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the viewer(s) disputing.

11. Subject to rule 10, only the courts in Mumbai shall have the sole and exclusive jurisdiction to decide on any dispute relating to the Contest.
