Watch & Win Contest For Dhonni Meye: Rules & Regulations

"WATCH & WIN CONTEST FOR DHONNI MEYE" ("Contest") will be held on STAR JALSHA("Channel") as stated hereunder:

1. The Contest shall commence from January 4, 2010 at 18:00:00 hours and shall end on January 14, 2009 at 18:30:00 hours ("Period") on the Channel.

2. The Contest will be pertaining to the program titled "Dhonni Meye" ("Program") telecast on the Channel at Monday - Saturday at 6.00 pm. On air promos shall be telecast on the Channel during the Period which will state the mechanism (manner) in which the viewers have to participate in the Contest.

3. The viewers interested in participating in the Contest must watch the Program telecast on the Channel and answer the question asked during the break of the Program.

4. The Contest shall have one question pertaining to the Program. The contestants will have to answer a question which will be followed by three options asked during the break of the Program. The question asked will be pertaining to the Program telecast on the Channel.

5. Contest lines open from January 4, 2010 at 18:00:00 hours and close on January 14,2009 at 18:30:00 hours("Timeline"). In respect of question asked during the Program, the viewers will have to send in their answers within the Timeline.

6. The viewer(s) who is interested in participating in the Contest should send SMS to 57827 ("Contestant(s)"). The SMS should contain the keyword DM followed by followed by the alphabetic answer option (i.e. A or B or C), which the Contestant(s) believes is the correct answer to the question.

7. The SMS containing the answer to the question asked in the promo must be sent by the Contestant(s) to 57827 any time during the Timeline stated above. Answers sent after the Timeline stated in this rules and regulations shall not be considered and shall be null and void.

8. Only the Contestant(s) who are subscribers of Vodafone, Aircel, Idea, Reliance Communications, Spice, BSNL, Tata Indicom, Airtel, Reliance Telecom, BPL, MTNL Mumbai, will be able participate in the Contest by sending an SMS.

9. The cost of the SMS shall be solely borne by the Contestant(s). The cost charged to the Contestant(s) by the respective mobile operators for each SMS will be as follows:

Rs. 3: Vodafone, Aircel, Idea, Reliance Communications, Spice, Tata Indicom, Airtel, Reliance Telecom and BPL.

Rs. 2: BSNL.

Rs. 1: MTNL Mumbai.

10. STAR Entertainment Media Private Limited ("SEMPL") and/or the Channel shall not be responsible in the event of any network problem and/or the cost of the SMS charged by the mobile operator. Any dispute in connection to the same shall be settled between the subscriber and the mobile operator directly and without involving SEMPL and/or the Channel

11. Neither SEMPL nor the Channel shall be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the network operator. Any dispute in connection to the same shall be settled between the Contestant(s) and the network operator without involving SEMPL or the Channel.

12. In case of telecom and/or network failure and/or website access problem and/or for any other reason whatsoever, SEMPL reserves the right to change the mechanism or take such necessary steps as it may deem fit.

13. All the entries should state all the required information, which have been asked from Contestant(s).

14. SEMPL and/or the Channel shall randomly select winner(s) for the following three (3) categories of prizes amongst those Contestant(s) who have sent correct answers to the question asked during Contest pertaining to the Program. Winner(s) shall not be entitled to more than one (1) prize;

14.1 Category 1 - There will be two (2) prize winners for this category ("First Prize Winner(s)"). Each First Prize Winner will receive a pass ("Prize") for dinner at any 5-Star hotel with Koel and Dev;
14.2 Category 2 - There will be one (1) prize winner of Dev's autographed Jacket for this category ("Second Prize Winner ") ("Prize").
14.3 Category 3 - There will be four hundred and thirty (430) prize winners for this category ("Miscellaneous Prize Winner(s)") who shall receive prizes as stated under:
(i) One hundred and thirty (130) winners will be selected and each will receive movie ticket for the film Bolo Na Tumi Amar for the weekend ("Prize"). Out of total One hundred and thirty (130) winners forty (40) winners will be selected from Kolkata, twenty (20) winners will be selected from Bolpur, twenty (20) winners will be selected from Durgapur, twenty (20) winners will be selected from Asansol, and thirty (30) winners will be selected from Siliguri;
(ii) Hundred (100) Winners will be selected and each Winner will receive one cap ("Prize");
(iii) Hundred (100) Winners be selected and each Winner will receive one T-shirt ("Prize");
(iv) Fifty (50) Winners be selected and each Winner will receive one Audio Cassette of Bolo Na Tumi Amar ("Prize");
(v) Fifty (50) Winners be selected and each Winner will receive one CD of Bolo Na Tumi Amar ("Prize");

The First Prize Winner(s), Second Prize Winner(s) and Miscellaneous Prize Winner(s) are hereinafter collectively referred to as the "Winner(s)".

15. The name of the Winner(s) shall be displayed on the website www.indya.com by SEMPL and/or the Channel. In the event of the Winner(s) not being reachable for any reason whatsoever, SEMPL/ the Channel shall have the right to select an alternative Winner.

16. SEMPL and/or the Channel reserves the rights to decide the Winner(s) and the ranking of the Winner(s) of the Contest. SEMPL and/or the Channel's decision in regard to Winner(s) shall be final and binding. No communication or objection shall be entertained in this regard.

17. By participating in the Contest, it shall be construed that the Winner(s) has waived his/her right to raise any dispute with regard to the Contest and/or in any manner whatsoever in connection to the Prize including the brand, quality, value etc. of the Prize.

18. All and any incidental costs direct and/or indirect including TDS, in relation to the Prize, shall be borne by the Winner(s) and in no manner whatsoever shall the Channel/SEMPL, be responsible for the same.

19. SEMPL and/or the Channel reserves the right to withdraw at any time the Contest without giving any prior notice thereof to the Contestant(s) or change the timings of telecast of the Program on the Channel.

20. The Winner(s) shall not raise any dispute with regard to the Prize and/or in any manner whatsoever.

General Rules

1. The Contestant(s) should be citizens of India, residing in India and above 18 years of age to qualify for the Contest.

2. The Contestant(s) should not have criminal conviction or an arrangement or a contract that prevents the Contestant(s) from participating in the Contest.

3. The Contestant(s) in whose name the mobile number (from which the message is sent) is registered with a network operator shall be construed to have sent the SMS. Consequently, the Winner(s) whose name the mobile number (from which the message is sent) is registered with a network operator shall be entitled to Prize.

4. Proof of age is a must for the Contestant(s) and must be submitted to the Channel/ SEMPL (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

5. The Channel reserves all rights to make amendments to the existing rules without prior notice or withdraw the Contest without giving prior notice in connection thereto.

6. Non-conformance by any Contestant(s) and/or the Winner(s) of the rules of the Contest will disqualify them from participation or winnings, immediately, as the case may be.

7. The Contestant(s) and the Winner(s) of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or SEMPL and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Winner(s). Further, the Contestant(s) and the Winner(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Contestant(s) and Winner(s) agrees that the footage of any nature with regard to the Contestant(s) and the Winner(s) shall vest with SEMPL, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

8. The Winner(s) shall not be entitled for any another item or cash equivalent in place and stead of the Prize. If the Winner(s) refuses to accept the Prize, the Channel and/or SEMPL shall be released from all obligations towards the Winner(s) in connection to the same. Further, after forfeiting the Prize, SEMPL and/or the Channel shall be entitled to randomly select and declare another Winner(s), as it deems fit, and give the Prize, to that Winner(s).

9. The Winner(s) shall provide their address as required by SEMPL and/or the Channel and the Prize shall be courier to the said address provided by the Winner(s) by SEMPL and/or Channel. The Winner(s) agrees that he/she shall not hold SEMPL and/or its employees, responsible for delays in delivery due to shortage of stocks from the suppliers of the Prize or damage during transit or any problem in connection to the Prize. The Winner(s) further agrees that he/she shall not hold responsible SEMPL, in the event, the Winner(s) fails to take possession of the Prize for any reason whatsoever. In such an event, the Winner(s) right to the Prize shall be forfeited.

10. By participating in the Contest, it shall be deemed to be construed that the Contestant(s)/Winner(s) has waived his/her right to dispute in relation to the Prize so offered to the Contestant(s)/Winner(s) upon winning the Contest. If the Winner(s) refuses to accept the Prize, the Channel and/or SEMPL shall be released from all obligations towards the Winner(s) in connection to the Prize won by the Winner(s).

11. By participating in the Contest, it shall be construed that the Contestant(s)/Winners has agreed that the Contestant(s)/Winner(s) shall hold harmless the Channel, SEMPL, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by the Contestant(s) and/or the Winner(s), in any manner, whatsoever in connection with the Contest and that the Contestant(s) and the Winner(s) has waived all rights to file in person or through any family member or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or SEMPL to claim any damages or reliefs or otherwise.

12. By participating in the Contest, it shall be construed that the Winner(s) of the Contest has agreed that the Winner(s) shall, at all times, hold harmless the Channel, SEMPL, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her in any manner, whatsoever, in connection with the Prize and that the Winner(s) shall also not file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or SEMPL to claim any damages or reliefs or otherwise.

13. The Winner(s) agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or SEMPL, the Winner(s) is not able to receive a Prize, the Channel and/or SEMPL cannot be held responsible for the same.

14. The Channel and/or SEMPL is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Winner(s) in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or the Prize.

15. Employees of the Channel, SEMPL, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

16. Participation of the Contestant(s) in the Contest shall be construed that the Contestant(s) has waived his/her right to dispute any decision(s) made by SEMPL and/or the Channel in connection to the Contest and that the Contestant(s) agrees to all the decision(s) made by SEMPL and/or the Channel. All the decision shall be final and binding upon them.

17. SEMPL and/or the Channel reserve the right to forfeit the Prize in the event it is found by SEMPL and/or the Channel that any information provided by the Contestant(s) or the Winner(s) is wrong or any misrepresentation is made by the Contestant(s) or the Winner(s). SEMPL or the Channel shall have the right to declare another Contestant(s) as the Winner(s) of the Contest and give the Prize to that person.

18. All Contestant(s), the Winner(s), shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or SEMPL in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to SEMPL and/or the Channel herein.

19. The participation of the Contestant(s) in the Contest shall mean that the Contestant(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.

20. The Contestant(s) shall comply with the laws of India.

21. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by SEMPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Contestant(s) who has raised the dispute.

22. Subject to the provision of Clause 21, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim reliefs under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.
